FromBeyond.co ("FromBeyond.co", "we", "us", or "our") provides a platform that allows users to create and schedule video messages, funeral celebrations, will explanations, and other personal content for delivery to nominated recipients in the future. Because our service involves deeply personal and sensitive content — including material related to end-of-life wishes and family legacy — we take your privacy seriously and are committed to handling your information with care and respect.

This Privacy Policy should be read alongside our Terms of Service, also available at FromBeyond.co. Together, these documents set out the full basis on which we collect, use, and process your Personal Information. By using FromBeyond.co, you agree to the practices described in this Privacy Policy and the Terms of Use and as may be amended from time to time for reasons such as changes to law, regulations, technology and/or the provision of our services.

Personal Information has the meaning given to that in the Privacy Act 1988 (Cth).

Third-party service providers/platforms: our platform currently uses third-party service providers including Amazon Web Services (hosting and infrastructure) and Stripe (payment processing).

1. Information We Collect

1.1 Information You Provide

  • Account information: your name, email address, and password when you register
  • Profile information: any additional details you add to your account
  • Content: video recordings, audio files, written messages, images, and documents you upload or create on our platform.
  • Recipient information: names, email addresses, phone numbers, delivery timing instructions, and any other details you provide to configure delivery of your content to nominated recipients. You are responsible for the accuracy and completeness of all recipient information you provide. We do not independently verify recipient details
  • Payment information: billing details processed securely and directly through Stripe. We do not store your full card number — Stripe handles all payment data under their own PCI-DSS compliant systems. This is all done via third party platform, Stripe.
  • Communications: messages or enquiries you send to us

1.2 Information We May Collect Automatically

  • Usage data: pages visited, features used, time spent on the platform, and interaction logs
  • Device and technical data: IP address, browser type and version, operating system, and device identifiers
  • Cookie and tracking data: as described in Section 7 of this policy.

1.3 Sensitive Content

The nature of our service means the content you create may be inherently sensitive — including messages about death, grief, family relationships, financial matters, and personal wishes. We treat all user-created content as sensitive Personal Information and apply heightened protections accordingly. We do not access, review, or process the substance of your content except where necessary to deliver our service or as required by law.

2. How We Use Your Information

The types of Personal Information we or a third party on our behalf (i.e. payment provider) collect will depend on the circumstance of such collection.

We may use the information we collect for the following purposes:

  • To create and maintain your account
  • To store, manage, and deliver your scheduled messages and content to nominated recipients at the times and in the manner you specify
  • To process payments through Stripe. For the avoidance of doubt, we don’t directly collect any payment information, this is all done directly through Stripe.
  • To send transactional emails and notifications, including account confirmations, delivery notifications, and security alerts
  • To analyse usage patterns and improve our platform
  • To respond to your support requests and communications
  • To detect and prevent fraud, abuse, or security incidents
  • To comply with our legal obligations under applicable Australian laws
  • Where a scheduled delivery fails, we may attempt redelivery using the contact details you have provided. We are not obligated to do so and will not attempt redelivery using details other than those you have supplied

You retain full ownership of all content and Personal Information you provide. By using our service, you grant FromBeyond.co a perpetual, irrevocable, non-exclusive licence to store, process, and deliver your content solely in accordance with your instructions. This licence exists only to operate the service and ends when your content or account is deleted.

We do not use your Personal Information for advertising or behavioural profiling. With your consent, we may send you marketing communications about our services, which you can opt out of at any time via the unsubscribe link in any email or by contacting us at hello@FromBeyond.co. We do not sell, rent, or trade your personal data to any third parties.

3. Third-Party Service Providers/Platforms

We share your information (or you directly share your information) with trusted third-party and technology providers/platforms who are necessary to operate our platform. Each third-party provider/platform operates as an independent entity, subject to its own terms of service and privacy policy, which govern how it handles data on its platform.

Amazon Web Services (AWS)

FromBeyond.co partners with Amazon Web Services (AWS) as our primary technology infrastructure provider. AWS supports the core functions of our platform, including secure hosting and storage of your content and data, processing of video and voice recordings, our AI voice assistant Nex, delivery of transactional emails and notifications, and, where applicable, delivery of SMS messages.

Your content and data are stored and processed on AWS infrastructure globally. AWS maintains internationally recognised security certifications and its own data processing and privacy terms, which govern how it protects and handles data on its infrastructure. Details of AWS's current certifications and data handling practices are available at aws.amazon.com. As these are maintained and updated directly by AWS, we recommend referring to AWS's own documentation for the most current information.

Where our AI voice assistant, Nex, processes your voice audio and conversation transcripts, this occurs within AWS infrastructure under AWS's data processing terms. Your voice data and conversation content are not used to train any AI model. This reflects AWS's default data handling policy, which we do not opt out of or override.

Stripe

Payment processing. Stripe operates in line with industry-standard payment security practices. When you make a payment, your financial information is transmitted directly to Stripe and is not stored on our servers. Stripe maintains its own terms of service and privacy policy governing how it handles data, available at www.stripe.com. FromBeyond.co does not receive or store your full payment card details.

4. Data Retention

4.1 Account and Profile Data

We retain your account and content information (which may include Personal Information) for as long as your account is active and where we are required to retain it for legal or compliance purposes. Once your account is closed and we no longer require your information for these purposes, we handle its retention and destruction in accordance with clause 4.4. Retention of your account and content information is governed by FromBeyond.co's policies as set out in this section 4.

4.2 User-Created Content (Videos, Messages, and Scheduled Deliveries)

Content you create on FromBeyond.co, including video messages, uploaded scripts or documents, and scheduled deliveries, is retained indefinitely by default. This is intentional: many users create content intended to be preserved and delivered far into the future, including posthumously. The retention approach described in clause 4.4 does not apply to this content; scheduled and legacy content is retained in accordance with this clause 4.2 until you either delete specific content or delete your account, as set out below.

You may permanently delete individual content at any time through your account settings. Please note that requesting closure of your account by emailing hello@FromBeyond.co will permanently delete all content associated with it, including any scheduled or future deliveries, and this cannot be reversed or recovered. If you wish to preserve your scheduled deliveries, you should not request account closure; if you are unsure, please contact us at hello@FromBeyond.co before proceeding.

The accuracy and completeness of all delivery details, including recipient contact information and timing instructions, is your responsibility. FromBeyond.co and relevant third party platforms solely rely on the information you provide and does not verify recipient details. Inaccurate information may result in failed or misdirected delivery.

4.3 Payment Records

Payment transaction records are retained by third party platform provider, Stripe, in accordance with their terms and conditions. Payment records are not stored or captured by FromBeyond.co.

4.4 Retention of Information

We retain your Personal Information for as long as it is reasonably necessary for the purposes for which it was collected, including to provide our services, meet legal and regulatory obligations, resolve disputes, and enforce our agreements. Once we no longer need your Personal Information for these purposes, and are not otherwise required by law, or by a court or tribunal order, to retain it, we will take reasonable steps to destroy or de-identify it.

This clause applies to account and profile information we directly hold. It does not apply to scheduled or legacy content, which we retain and manage in accordance with clause 4.2. AWS provides the underlying infrastructure on which your information is stored, but retention decisions for content and account data are made by FromBeyond.co, not AWS. Where information is held directly by other third party platforms in connection with their own services, that information is retained in accordance with those platforms' own terms.

5. Cross-Border Data Transfers

FromBeyond.co is based in Australia, but our use of AWS means your data may be stored or processed in multiple regions globally. Where your data is transferred outside Australia, we ensure that appropriate safeguards are in place, including:

  • Contracting with providers (such as AWS and Stripe) who maintain internationally recognised security certifications and data protection standards, details of which are available on their respective websites

By using our services, you acknowledge and consent to the transfer of your information to countries outside Australia in order to deliver the services by us and the relevant third party platforms.

6. Disclosure of Your Information

We may disclose your information in the following limited circumstances:

  • Service providers: as described in Section 3, to trusted providers who operate our platform
  • Legal obligations: if required to do so by law, court order, or lawful request from a government or regulatory authority
  • Safety and security: where we reasonably believe disclosure is necessary to protect the rights, property, or safety of FromBeyond.co, our users, or the public
  • Business transfers: in the event of a merger, acquisition, or sale of assets, your data may be transferred to a successor entity.

7. Cookies and Tracking Technologies

We may use cookies and similar tracking technologies on our website and platform. Cookies are small text files stored on your device that help us operate and improve our service. We use the following types:

  • Essential cookies: required for the platform to function, including session management and authentication. These cannot be disabled without affecting your ability to use the service
  • Preference cookies: used to remember your settings and preferences between sessions

You can control and manage cookie settings through your browser. Disabling non-essential cookies will not affect your ability to use the core features of our platform. For more information on managing cookies, visit allaboutcookies.org.

8. Security

We implement industry-standard security measures to protect your Personal Information and content, including:

  • Encryption of data in transit using TLS (Transport Layer Security)
  • Encryption of data at rest on AWS infrastructure
  • Access controls limiting who within our team can access user data
  • Regular security reviews and monitoring of our systems

To the extent permitted by law, we are not responsible for unauthorised access, sharing, or distribution of content resulting from the forwarding, interception, or misuse of delivered links.

Despite these measures, no system is completely secure. If we become aware of a security incident affecting your Personal Information, we will take prompt steps to address it and notify you where appropriate.

9. Your Privacy Rights

We choose to apply the Australian Privacy Principles (APPs) as best practice because we believe you deserve transparency and control over your information. You have the following rights in respect of Personal Information we directly hold about you:

  • Access: you may request a copy of the Personal Information we hold about you by contacting us at hello@frombeyond.co
  • Correction: if any Personal Information we hold about you is inaccurate or out of date, please contact us at hello@frombeyond.co. We will use our best endeavours to correct it promptly
  • Deletion: you may request deletion of your Personal Information, subject to our legal obligations and the terms of Sections 4.2 and 4.4
  • Withdrawal of consent: you may withdraw consent to processing at any time, though this may affect your ability to use our services
  • Complaints: if you believe we have mishandled your Personal Information, please contact us at hello@frombeyond.co in the first instance so we have the opportunity to resolve your concern directly. If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au

10. Children

Our services are not directed at or intended for use by individuals under the age of 18. We do not knowingly collect Personal Information from children. If you become aware that a child has provided us with Personal Information without parental consent, please contact us at hello@FromBeyond.co and we will take all reasonable steps to remove that information promptly.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The current version will always be available at frombeyond.co.

Your continued use of our services after changes take effect constitutes your acceptance of the updated policy.
